TERMS OF USE

These Terms of Use (“Terms of Use”) on this webpage (“Agreement”) apply to AcadeMode’s Website located at www.academode.com (“AcadeMode” or “Website”). The Agreement describes the provisions that regulate the legal relationship between AcadeMode as a provider of the Services and You as a user of the Services (“You” or “Customer”). By accessing this Website, You agree to these Terms of Use. If You do not agree to be bound by this Agreement or the privacy policy provisions referenced herein, please discontinue using this Website.

In this Agreement:

“Company” or “We” refers to AcadeMode’s Website, the provider of Admission Consulting Services to Customers.

“Customer” refers to the person who places Orders with the Company and follows these Terms of Use.

“Order” refers to the actual request for Admission Consulting Services sent to AcadeMode by the Customer which includes particular requirements for specific consulting services (“Services”).

“Admission consulting services” are the outcome of the Order individually delivered to the Customer in accordance with their specifications.

“Application materials” refer to the materials that the Customer will submit to AcadeMode for review including any written materials that will be a part of any application for admission to the academic institution.

“Support personnel” refers to the structural unit of the Company which is responsible for managing and facilitating the Order process.

“Expert” is the person employed by AcadeMode as a freelancer who provides Admission Consulting Services to the Customer in accordance with this Agreement.

  1. Order Placing

1.1. The Customer may request the Service by placing the Order (filling in the Order form) on the Website or by receiving any assistance on this from the Support Personnel.

1.2. The Order form defines the volume of work, Order instructions, and turnaround terms. The Customer is responsible for the provision of the full and accurate final description of the Order on the Order form or to AcadeMode’s Support Personnel that will assist the Customer with the Order.

1.3. The Customer’s name, email address, and phone number must also be provided to facilitate the Order completion process. If any of the Customer’s contact details or Order instructions change over time, it is the Customer’s responsibility to inform the Support Personnel of it.

  1. Order Payment

2.1. The Customer pays for the Order on the advance payment basis and in accordance with the prices indicated on the Website. The advance payment basis presupposes that the Company cannot start Order processing activities without receiving the full payment for the Order. The Company accepts payments made via PayPal, credit cards, or Wire Transfer. The Wire Transfer payment may take from 3 to 14 business days to reach its recipient.

2.2. The Company uses PayPal as a platform for all payments. To proceed with the payment, the Customer is required to pass PayPal Checkout.

2.3. When using the credit card for making payment, the Customer will need to fill in the PayPal form. This is an obligatory procedure to secure payment for the Order; though, this procedure does not imply the creation of a permanent PayPal account; it is only required for a one-time transaction.

2.4. AcadeMode cannot be held accountable for any procedural or technical errors that may happen during PayPal’s processing of the payment, including but not limited to:

  • Technical issues on the part of the Customer’s bank or PayPal.
  • The payment which appears as Under Review for PayPal to review it.
  • The eCheck payment which can take up to 10 business days to be deposited into the payee’s checking account.

2.5. If the transaction fails and prior to contacting the Support Personnel for assistance, the Customer is recommended to check the card balance, review online purchase limits, and/or check card validity.

2.6. AcadeMode assumes no obligations until the Customer has received a confirmation email from AcadeMode’s authorized representative. AcadeMode reserves the right to reject any Order for any reason whatsoever.

  1. Order Process

3.1. Order validation. AcadeMode is entitled to re-examine the Order details the Customer provided in the Order form and to the Support Personnel via any communication channels after the payment has been made. This is done to make sure that the Order details match. The Support Personnel reserves the right to contact the Customer if there is a need to clarify any of the Order details.

3.2. Change of Order details. The Customer may request the Support Personnel to make changes to the volume of work provided initially. Changes that impact the number of applications, turnaround time, or Service type of the Order may require additional payment. The Support Personnel will contact the Customer to inform them of the additional payment and discuss the details. Note: The change of Order details is not possible once the Expert has started working on the Order.

3.3. Providing admission materials. Before the Expert starts working on the Order, the Customer is asked to provide answers to a questionnaire and/or other necessary materials (resume, cover letter). In the questionnaire, AcadeMode asks targeted questions; be thoughtful and honest and tell us everything. Here, the Company starts to identify Your most powerful business school application opportunities. It is the Customer’s responsibility to provide the Expert with any specific material that the Customer deems necessary for the successful Order completion.

3.4. Communication. The Customer reserves the right to contact their Expert via email. Once the Expert is assigned, AcadeMode will provide the Customer with the Expert’s email address to start communication. The Support Personnel is available 24/7 via the online chat, email, or phone.

3.5. Progress tracking. It is possible for the Customer to track the Order completion process by contacting the Support Personnel via the communication channels listed above or their Expert via email.

3.6. Service delivery. The Company is held accountable for the successful completion of the Order by the deadline. There are two delivery plans:

3.6.1. Regular rates secure the turnaround of up to 2 business days. Regular rates (2 business days) mean that the Customer will receive assistance within 2 business days after providing all of the necessary materials. After the Customer performs the necessary changes and sends the materials back to AcadeMode, an Expert has 2 more business days for the answer. Thus, it does not mean that the whole process of our help takes 2 business days only.

3.6.2. Rush rates allow for the turnaround of up to 24 hours for each submission. Rush rates (24 hours) mean that the Customer will receive assistance within 24 hours after providing all of the necessary materials. After the Customer performs the necessary changes and sends the materials back to AcadeMode, an Expert has 24 more hours for the answer. Thus, it does not mean that the whole process of our help takes 24 hours only.

3.7. NOTE: Turnaround time starts from the moment the Customer provides all of the information necessary for the Expert to start working on the Order.

3.8. The Customer will be informed by the Support Personnel if additional time is required because of the complexity of the task. The completed Order is provided in the written form and sent to the Customer’s email address. It is the Customer’s responsibility to download the completed Order on time. AcadeMode disclaims all responsibility regarding any technical issues that may arise from the Customer’s side and hinder the downloading of the product on time.

  1. Order Use

4.1. The Orders produced by AcadeMode are meant for informational and educational purposes only. The Customer shall not understand and/or intend to use the information and downloadable resources presented on the Website as professional advice. Beyond all doubt, the information presented on the Website reflects the matters within the area of professionalism of AcadeMode; however, it cannot replace professional advice from the competent person who is aware of the Customer’s individual situation. Neither AcadeMode nor its employees and/or representatives cannot be made liable for any errors or omissions on the Website.

4.2. AcadeMode, any of its employees, or representatives shall not be held liable in case if the Customer will suffer any damage or loss as a result of failing to ask for advice from the competent person who is aware of the Customer’s individual situation.

  1. AcadeMode’s Acknowledgments and Responsibilities

5.1. As a consultant, AcadeMode shall make use of commercially reasonable efforts to provide the Customer with advice in regard to all of the materials delivered by the Customer to AcadeMode for review as well as any written materials that will be a part of any application for admission to the academic institution.

5.2. AcadeMode shall employ reasonable efforts to provide its comments to any drafts of the Application Materials whether by email, phone, or chat. The Company is obliged to deliver the comments within a reasonable amount of time after receiving such drafts not to exceed 2 business days.

5.3. At all times, AcadeMode shall treat the Customer with respect and shall work with the Customer in a professional manner.

  1. Customer’s Acknowledgements and Responsibilities

6.1. The Customer acknowledges that they are the applicants to the academic institution, they will write all of the Application Materials and essays, and they take responsibility for all of the resumes, essays, and/or other documents submitted to or produced by the Company. AcadeMode does NOT compose, draft, complete, or write any essays; AcadeMode does not “put notes together.”

6.2. The Customer will not hold AcadeMode, its Support Personnel, Experts, and other representatives accountable for any rejected admissions to any undergraduate, graduate, or professional program or school or any denial of employment.

6.3. AcadeMode has made NO representations about what AcadeMode’s Services will do for the Customer’s chances of admission to any undergraduate, graduate, or professional school or program or for the Customer’s chances of employment at any institution, corporation, business, or government agency.

6.4. Services presented on AcadeMode’s Website and which are purchased by the Customer are provided on an “AS-IS” basis without any warranty of any kind, either express or implied. Not for any reason whatsoever will AcadeMode, its Support Personnel, Experts, and other representatives be held accountable for any damages of any kind, including without limitation compensatory, direct, indirect, or consequential damages, loss of income or data, loss of or damage to property, and claims of third parties arising from any Customer’s rejection from any undergraduate, graduate, or professional program or school of any kind. AcadeMode disclaims any and all implied or express warranties, including but not limited to the applicability of essays, resumes, or letters for a particular purpose and the Customer’s applicability for any job or undergraduate, graduate, or professional program or school.

6.5. All Services are provided on a prepaid basis. AcadeMode will not provide Services unless the Customer has first paid for these Services and agreed to these Terms of Use.

6.6. While AcadeMode may in the case of need explain the Services to parents or other potential payers, AcadeMode does not work with parents, siblings, or other Customer’s proxies. Unless the Customer is a recommender ordering a Letter of Recommendation Development Service or an applicant ordering a Letter of Recommendation Development Service for the Customer’s recommender, our Customer is always the applicant.

6.7. The Customer should respond with the revised materials to all AcadeMode’s comments within 72 hours after receiving such comments.

6.8. The Customer has 60 days to begin work after receiving the confirmation email from AcadeMode’s authorized personnel. This period is subject to change upon condition that certain agreements were concluded in writing (inclusive of email correspondence) between the Customer and AcadeMode’s representatives up to the time of the purchase.

6.9. If 60 days after the last contact date passed, no custom timetables were agreed in writing (including email correspondence) by both parties in relation to this, and the Customer fails to respond to any outreach efforts of the Support Personnel (by phone or email), the Company reserves the right to cease any obligations to the Customer.

6.10. If the Customer fails to respond to any outreach efforts of the Support Personnel (by phone or email) for the period of 180 days, the Company reserves the right to cease any obligations to the Customer.

6.11. The Customer warrants that all and any information provided to AcadeMode is accurate to the best of the Customer’s knowledge.

6.12. The Customer warrants that they have reached the age of majority in the Customer’s jurisdiction. In case if the minor uses the Services, the Company considers it as the situation in which the Customer, not the minor, has custody of the minor and assumes responsibility for the financial wellbeing of the minor. In addition, the Company judges such actions as the ones in which the Customer, not the minor, will incur any costs associated with the purchasing of AcadeMode’s Services and covering of all and any fees of wire transmittals or full or partial refunds.

6.13. The Customer acknowledges that the Company will periodically send newsletters via email to announce any news, special offers, discounts, and more. The Customer reserves the right to opt out of the mailing list at any time.

ACADEMODE DOES NOT GUARANTEE THAT THE WEBSITE OR CONTENT OR ANY OF THE SERVICES OF THE WEBSITE WILL BE ERROR-FREE OR THAT YOUR USE OF THE WEBSITE WILL BRING ANY SPECIFIC RESULTS. THE WEBSITE AND ITS CONTENT ARE DELIVERED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. ALL OF THE INFORMATION PROVIDED ON THE WEBSITE IS SUBJECT TO CHANGE WITHOUT PRIOR NOTICE. SHOULD YOU FEEL DISCONTENTED WITH ALL OR ANY PART OF THIS WEBSITE, YOUR ONLY CORRECTIVE ACTION IS TO STOP USING ALL OR PART OF THIS WEBSITE. ACADEMODE DISCLAIMS ANY AND ALL IMPLIED OR EXPRESS WARRANTIES, INCLUDING BUT NOT LIMITED TO THE APPLICABILITY OF ESSAYS, RESUMES, OR LETTERS FOR A SPECIFIC PURPOSE AND YOUR APPLICABILITY FOR ANY JOB OR UNDERGRADUATE, GRADUATE, OR PROFESSIONAL PROGRAM OR SCHOOL. THROUGH ACCESSING AND USING THIS WEBSITE, YOU ACCEPT PERSONAL RESPONSIBILITY FOR THE RESULTS OF YOUR ACTIONS.   1. Money Back Guarantee

8.1. Procedure

To request compensation, the Customer should contact the Support Personnel of AcadeMode within the period of 6 months after the date of securing payment. The procedure of the Customer’s request examination may take up to 5 business days. On the end of the examination, the Support Personnel will contact the Customer via phone or email to offer the resolution. The Support Personnel retains the right to contact the Customer in the period less than 5 business days to request any of the additional materials or information that may be required in the framework of the examination procedure.

8.2. Refund Policy

You consent and understand the following provisions of the refund policy of AcadeMode:

8.2.1. AcadeMode does not provide compensation for the already performed work.

8.2.2. We charge a non-refundable one hour, one-time minimum since Your first Order requires at least one working hour of the Expert for the proper provision of the Services to You.

8.2.3. We offer a 6-month period from the date of purchase for You to request a refund for unused Services. No refunds will be processed if the refund process is initiated upon the expiry of 6 months.

8.2.4. If You purchase an Hourly Plan and initiate a refund procedure within 6 months following the purchase date, AcadeMode will calculate Your refund as follows: The Amount Paid – (Current Hourly Rate*Time), where “Time” is the time our Expert(s) allocated for the proper provision of Services to You. This time cannot be less than one hour.

8.2.5. If You purchase one or multiple flat-rate packages and initiate a refund procedure within 6 months following the purchase date, AcadeMode will calculate Your refund as follows: 95% of (The Amount Paid – (Current Hourly Rate*Estimated Time)). Please be aware that AcadeMode’s Experts do not track their time working on admission components or school packages so “Estimated Time” will always be an estimate, and the first applications always take the most time. This time cannot be less than one hour.

8.2.6. If the need arises to process a refund via any means other than the PayPal account or credit card, AcadeMode reserves the right to deduct a processing fee of $75.00 from the refund amount.

8.3. Rush Service

8.3.1. AcadeMode shall employ all reasonable efforts to provide the Customer with the work in 24 hours or less. If AcadeMode fails to do this within 24 hours as promised, the Customer reserves the right to request for a refund in the amount of the charge attributed to the late Rush Rates Service.

8.3.2. If the Customer does not order Rush Rates Service and will not be able to return the revised materials due to time restrictions, AcadeMode takes no responsibility beyond the Company’s regular 2 business days’ turnaround.

8.4. Refund processing

As soon as the Customer receives a refund confirmation, AcadeMode will process it within 5 business days from the date of the confirmation receipt. Please be informed that the Company cannot be held liable for any bank transfer fees, specifics of a transfer, and possible delays which can take place as a result of bank service issues.

  1. Use of Free Downloadable Content

9.1. The Company makes available, with a personal, non-exclusive, and non-transferable license, different resources on the Website (“Freemium Content”), which Customers may access for their personal or internal business use. With the exception of use cases listed above, the Customer acknowledges and agrees that they have no right to modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance or in any other way exploit any of the Freemium Content available on the Website.

9.2. The Customer acknowledges and agrees that the Freemium Content they download may only be used by them for their personal or internal business use and may not be sold or redistributed without the express written consent of AcadeMode.

9.3. The Customer further acknowledges and agrees that they shall not create any derivative works on the basis of the Freemium Content, and they shall not create and/or offer any competing products or services based upon any of the information presented in the Freemium Content.

  1. Miscellaneous Provisions

10.1. All Terms of Use that define and regulate the rights and obligations of both parties, the Customer and the Company, are presented in this Agreement. This document solely, its statements, provisions, or inducements, are to be considered valid or binding. After accepting the Terms of Use, this Agreement supersedes all of the previous written or verbal communications and/or agreements between the parties.

10.2. The Customer agrees that if a certain part of these Terms of Use is in conflict with any state law, it will not affect the rest of the document. The Customer’s rights and obligations will remain in full force and effect for all other provisions of this Agreement.

10.3. In its interpretation and performance, the Agreement is governed by the laws of AcadeMode’s physical location of its principal business, Cyprus (CY).

  1. Age Requirements

The Services are provided to individuals of the full legal age since AcadeMode does not collect or store the personal information of minors. If You presume that a minor gained access to the Website and placed an Order, AcadeMode hereby requests You to notify the Support Personnel immediately.

  1. When We Make Changes to Our Privacy Policy

AcadeMode reserves the right to issue amendments to this privacy policy anytime. If and when AcadeMode moves amendments, they will be emailed to the list of subscribers and will be posted on the Website and wherever AcadeMode considers it would be relevant. Any substantial amendments will come to force only after 30 days from the moment they were posted to allow Customers a sufficient amount of time to check them out and assume any measures that they believe serve their interests.

  1. Contacting Us

Our Support Personnel is available 24/7 by the phone, email, or chat. All and any of the Customer’s concerns will be responded to in the shortest time possible.

  1. Limitation of Liability

By consenting to follow the provisions of these Terms of Use, the Customer agrees to release and not make the Company or its employees, officers, agents, representatives, directors, shareholders, affiliates, promotion, advertising and fulfillment agencies, subsidiaries, any third-party providers or sources of information or data and legal advisers (the “Company’s Affiliates”) accountable for any and all damages, losses, claims, rights, and actions of any kind resulting from or associated with the Services, including but not limited to:

  • Hardware or software, electronic, telephone, network, Internet, email, or computer improper operation or failures of any kind.
  • Incomplete, delayed, defective, or failed computer transmissions.
  • Any situation arising from occurrences which the Company cannot control and that may cause the Services or products to be delayed, disrupted, or corrupted.
  • Any damages or losses of any kind arising due to the fact of or in consequence of making use of the Services.
  • Any printing or typographical errors in any materials relating to the Services.
  1. Pricing Adjustments

At AcadeMode’s sole discretion, the pricing of Services offered by AcadeMode may be modified over the period of any given year by the authorized representatives of AcadeMode. The pricing shall not be modified by the Customer or AcadeMode’s authorized representatives if the confirmation email has been sent to the Customer with the pricing for the particular Service to be provided.

  1. Terms and Conditions Amendments

The Customer agrees that AcadeMode can make amendments to these Terms of Use. The alterations will be posted on the Website; though, it is strongly recommended for the Customer to examine these Terms of Use regularly.
